PatentBridge® Services
PatentBridge offers a turn-key patent brokerage and patent licensing service whereby we act as exclusive representative of the patent portfolio, taking all necessary action on behalf of the client to broker and license its patents. This approach is exceptionally attractive to companies which do not have the ability, resources or inclination to represent their own patent portfolios, but instead prefer us to do so for them.
From mining the portfolio, analyzing the patents, reviewing the claims, developing the optimal brokering strategy, choosing potential candidates and infringers, making the initial contact, negotiating the deal from term sheet to execution of the final agreement, PatentBridge does it all.
PatentBridge offers the following services as part of its turn-key program.
The Most Important Aspect: The Deal-Making
Patents do not sell or license themselves. They are not treasures waiting to be discovered. Brokering a patent takes talent, experience, technical knowledge, salesmanship and a deep understanding of patents.
Brokering patents is also an art. An art we have been practicing for years. With PatentBridge you have the benefit of years of experience in negotiating numerous patent deals.
Brokering Strategy + Patent Licensing
Patent brokering and patent licensing require an understanding of the underlying technology. PatentBridge works with client in-house scientists and engineers to assure up-to-date comprehension of the technology, the competitive market, and sale opportunities. We confer with client executives to develop a strategy that protects client core technology yet offers patentees sufficient breadth in field of use to remain financially appealing.
PatentBridge reviews the claims of the patents to determine the proper industries and markets for commercialization.
PatentBridge proposes to our clients the most advantageous terms which we believe the market will accept.
PatentBridge identifies candidates and existing infringers.
PatentBridge prepares the marketing materials and makes the presentations.
PatentBridge analyzes the appropriate deal options available.
PatentBridge advises on the suitability of each option and the preferability of each identified candidate.
PatentBridge approaches both infringers and non-infringing candidates.
PatentBridge presents the deal terms and negotiates the whole spectrum, from term sheet to closing.
Most importantly, PatentBridge closes the deal.
Proving the Market; Selling the Company
Besides brokering, PatentBridge also engages in technology development using a simple business model: build patented technologies to prototype stage, sell to enough customers to prove market acceptance, then sell the technology or company at a premium to a larger entity.
PatentBridge Does The Heavy Lifting, Claim By Claim
PatentBridge believes that while mining and mapping programs may be helpful, there is no substitute for a thorough review of each claim of each patent by a competent professional. Software can not “read” or understand a patent claim. No matter how highly touted by their vendors, no program will alone adequately review or “mine” a portfolio.
Whether it uses citation metrics, word mining or other search variations, a computer program has not been invented that will do what a person knowledgeable in the technology and experienced in reviewing claims can do.
We review the patents ourselves, claim by claim. There simply is no substitute.
That is just one more compelling advantage offered by PatentBridge.
Review and Development of Patent Portfolios
The founder of PatentBridge has reviewed numerous patent portfolios using various techniques and programs. The overarching purpose of a review and analysis is to determine which patents offer the greatest chance of being brokered at the highest price or royalty rate.
The goal is both to analyze and establish priorities over which patents offer the most marketability and financial potential. The analysis technique PatentBridge uses often depends on the relevant art.
PatentBridge provides you with business marketing information and services to assist you in determining the value of your patent and how best to broker it. Once the determination is made, PatentBridge brokers your patents for you using its expertise to your greatest advantage.
Patent Mining and Mapping
We may avail ourselves of various mining and mapping programs during the initial review of the patents within the portfolio. This provides a high level perspective of the portfolio, while also indicating which patents may be brokered in tandem or which patents may be of interest to specific candidates.
PatentBridge deliberately does not maintain in-house mining or mapping software. Instead, we utilize third party mining and mapping programs. There are two reasons for this:
First, it allows us to select the program most appropriate to the particular art.
Second, this approach removes an inherent bias and resulting conflict of interest in a firm’s desire to select its own mining and mapping software over a more appropriate best of breed third party service.
There is no pressure or incentive to hire our own employees or engage our own services; we choose what is best for our client, not ourselves.
Best Economists
PatentBridge intentionally does not maintain a staff of in-house economists. Instead, we use as necessary the best economists available, not the ones on our payroll. This also allows us to use the most experienced in the particular technology.
The availability of the best talent is not static. The best people constantly move from firm to firm. Rather than try to employ them, we engage them as needed.
Best Scientists
For the same reasons we do not staff economists, we have opted not to maintain our own in-house stable of scientists and technical advisors. Cutting edge technology changes too rapidly for a small pool of in-house scientists to adequately and timely keep abreast of it. No one person can cover all aspects of every technical art; subspecialists are often required. It is near impossible to maintain the best subspecialists in-house.
Similarly, we have found that the best talent is rarely within one single firm. Scientists, like lawyers, frequently jump from firm to firm.
PatentBridge cherry picks the best, regardless of source. Our loyalty lies with our clients.
Enforcement of Patents
If a potential candidate is infringing a client's patent, we maintain relationships with national law firms specializing in aggressive patent infringement litigation on a contingency basis.
